Judge Deyvison Heberth dos Reis of the 3rd Criminal Court of Presidente Venceslau accepted on Thursday (18) the charges against influencer Deolane Bezerra, the top leader of the PCC, Marco Willians Herbas Camacho, as well as three other relatives of Marcola and the alleged financial operator of the group investigated in Operation Vérnix.
All now face charges of money laundering and criminal organization.
Deolane has been imprisoned in the Tupi Paulista Women's Penitentiary, 600 km from the capital, since May 21. Marcola has been serving a sentence since 1999 and is currently held in the Federal Penitentiary of Brasília.
The defense of Marcola, his brother Alejandro Juvenal Herbas Camacho Junior, and nephews Leonardo Alexsander Ribeiro Herbas Camacho and Paloma Sanches Herbas Camacho stated that they "will adopt all appropriate procedural measures to demonstrate the weakness of the accusatory narrative."
The defense of Deolane, led by criminal lawyer and professor Aury Lopes Jr., stated that the influencer "is innocent, her income has a lawful origin" and that she "has no connection with organized crime."
The judge highlighted in his decision excerpts from the investigation conducted by the Seccional Police Station of Presidente Venceslau and the charges presented by prosecutor Lincoln Gakiya of the São Paulo Public Prosecutor's Office, to support the evidence of Deolane Bezerra's involvement in the scheme.
The magistrate noted that Deolane "acted as a receiver of illicit funds from the Transportadora Lado a Lado, operated for the benefit of the PCC. Her bank account was used to receive fractional deposits coming directly from the shell company, at the behest of Everton ("Player"/"Temer"), Alejandro's financial agent."
According to the decision, analysis of LAB-LD (Laboratory of Technology against Money Laundering) reports showed transactions of R$ 27,002,774.72 "incompatible with declared economic capacity."
In the 17-page ruling that accepted the charges, the judge emphasizes that "the reports identify the repeated use of laundering techniques: use of intermediary companies, fragmentation and pulverization of deposits, integration of strawmen, and inconsistencies in income tax declarations."
"The audios sent to a cleaning lady indicate that Deolane kept funds belonging to the PCC in her properties and in those of her children. Additionally, the investigation uncovered a plan to restructure companies with transfers to funds in Dubai, a country notoriously associated with the use of shell companies to facilitate international asset laundering," the decision states.
Justice cites seizure of luxury cars
The court also cites the seizure of Deolane's luxury vehicles, among them a Mercedes-Benz AMG G63 4M and a Cadillac Escalade, both 2024/2025 models. According to the decision, the assets indicate a wealth pattern incompatible with the influencer's declared lawful income.
The investigation identified other vehicles linked to Deolane or companies connected to her, such as a BMW X1 S20i M Sport and a Lamborghini Huracan EVO.
The latter is registered under Deolane Bezerra Holding Patrimonial Ltda., which, according to police authorities, "reinforces the suspicion of using corporate structures to conceal the true ownership of assets."
Regarding the influencer's Lamborghini, the decision points to successive transfers of ownership between legal entities.
Before being registered under Deolane's holding, the vehicle is said to have belonged to Ryan SP Holding Patrimonial Ltda., a company linked to singer MC Ryan SP, who is also under investigation for suspected money laundering in Operation Narco Fluxo.
Evidence indicates Marcola benefited from transfers
Identified as the top leader of the country's largest criminal faction, Marcola is, according to the investigation, the "hidden owner of Transportadora Lado a Lado, together with his brother Alejandro."
"The evidence indicates that Marco Willians was the ultimate beneficiary of a portion of the financial transfers carried out by the transport company, with deposits documented in his favor. The handwritten notes seized at Penitentiary II of Presidente Venceslau point to him as the leadership that transmitted orders to the group," says the decision.
Operation Vérnix was carried out in May
On May 21, a task force of the General Police Department and the Attorney General's Office arrested Deolane at the luxurious Tamboré condominium in Alphaville, Greater São Paulo.
One day after returning from a trip to Rome, Italy, Deolane was surprised by police, who accuse her of maintaining a "repeated pattern of ostentation of high-value assets, incompatible, in theory, with her formally declared financial capacity," which, according to the investigation, "is relevant from the perspective of criminal prosecution aimed at crimes of money laundering and concealment of assets."
Deolane, 38, refused to testify to the Civil Police on May 27.
Throughout the hearing, at the Tupi Paulista Penitentiary, more than 600 kilometers from the capital, she remained silent, following the advice of her sister, lawyer Daniele Bezerra, according to the police.
Deolane's strategy disappointed and surprised the officers because she herself had protested to be heard during the investigation.
The day before, her sister posted online a lament that the influencer had written by hand. "I ask to be heard, just as was requested at the time of my arrest. I have never been a bandit."
The police wanted Deolane to explain the movement of R$ 40 million in her accounts — the suspicion is that the money came from the cash of a front transport company in Presidente Venceslau, used by the faction to conceal assets from organized crime, especially drug trafficking, one of the revenue sources for Marcola and his allies, according to the police and Public Prosecutor's Office.
What Deolane Bezerra's defense says
"The defense of Deolane Bezerra, sponsored by lawyers Aury Lopes Jr., Josimary Rocha de Vilhena, Luiz Ricardo Rodrigues Imparato, and Rogério Nunes, was informed of the acceptance of the charges presented by the Public Prosecutor's Office, an initial procedural act that does not represent any conclusion about the facts alleged.
The defense states that it will use all means of proof necessary to clarify the case, removing any allegation of illegality or criminal conduct, since her client is innocent, her income has a lawful and regularly declared origin, and Deolane has no connection with organized crime."
What the defense of Marcola and family members says
"Bruno Ferullo, lawyer for Marco Willians Herbas Camacho, Paloma Sanches Herbas Camacho, Leonardo Alexsander Ribeiro Herbas Camacho, and Alejandro Juvenal Herbas Camacho Junior, publicly states that the charges brought against his clients in the context of the so-called Operation Vérnix, in which they were accused of the crimes under article 2 of Law No. 12.850/2013 (criminal organization) and article 1 of Law No. 9.613/1998 (money laundering), were accepted by the Court of the 3rd District of Presidente Venceslau on June 16.
The Defense reiterates that Marco Willians Herbas Camacho and Alejandro Juvenal Herbas Camacho Junior have been held in a federal maximum-security penal facility since February 2019, subjected to severe restrictions on contact and communication, which in itself makes any participation in the investigated facts unfeasible and highlights the error of the accusation.
Leonardo Alexsander Ribeiro Herbas Camacho and Paloma Sanches Herbas Camacho also fully refute the allegations made.
The Defense emphasizes that the mere family bond with the other defendants cannot be confused with criminal participation, and it is unacceptable that simple affective proximity serves as a basis for an accusation of this magnitude.
As for the financial and property elements mentioned in the charges, the Defense clarifies that they will be properly contextualized during the trial, at which time the relevant clarifications and evidence will be presented regarding the origin and regularity of the operations pointed out by the prosecution.
The Defense, faced with the accusation, will adopt all appropriate procedural measures to demonstrate the weakness of the accusatory narrative and the groundlessness of the charges attributed to its clients, trusting that at the end of the regular trial, the truth of the facts will be duly recognized by the Judiciary."
