National Court of Justice Denounces 'Inexcusable Error' in Goleada Case Ruling

The National Court of Justice classified a Pichincha court's decision to revoke pretrial detention for Guayaquil Mayor Aquiles Alvarez and his brothers as a very serious infraction of inexcusable error.

The National Court of Justice (CNJ) classified as a "very serious infraction of inexcusable error" the decision of a Pichincha court to revoke the pretrial detention that was in force against the mayor of Guayaquil, Aquiles Alvarez, and his brothers, in the 'Goleada case'.

After this decision, the CNJ ordered that this resolution be notified to the Provincial Directorate of Disciplinary Control of the Provincial Directorate of the Judiciary Council, which would open the way to a possible sanctioning process against the judges who made up the court.

This occurs after on April 2, 2026, magistrates Silvia Velasco Velasco, Byron Uzcátegui Arregui, and Wiler Chóez Avilés, judges of the Specialized Criminal Chamber for the Prosecution of Crimes Related to Corruption and Organized Crime of the Court of Justice of Pichincha, ruled in favor of the appeal against the pretrial detention of Aquiles Alvarez and his brothers, and ordered their release.

On June 1 of this year, in the hearing of this case, the Prosecutor's Office accused the mother and cousins of Aquiles Alvarez of receiving in transfer the shares and capital of companies investigated in the Triple A case. According to the Public Ministry, these transfers were made through assets obtained as a result of the alleged illegal sale of fuel; and his wife, of being a beneficiary of Alvarez's businesses.

Among the evidence, the prosecutor stated that the mother of the mayor of Guayaquil, Gioconda Henriques, acquired on behalf of Inmobiliaria Fiorema S.A. vehicles valued at USD 325,000, USD 120,000, and USD 63,000, whose sellers were Aquiles Álvarez and Fiorella Icaza.

In the list of assets presented as evidence, there is a home valued at USD 1.2 million, a plot of land at USD 162,000, and an apartment at USD 120,000. The sellers were Inmobiliaria Álvarez H S.A., which was also represented by the mayor's mother, and Corpalubri, of the Álvarez family.

Here enters Fiorella Icaza, who as representative of Inmobiliaria Fiorema S.A., bought two apartments in Blue Bay on Isla Mocolí, valued at USD 304,000 and USD 335,000, and signed a promise to purchase the Petroquil gas station for USD 4 million, giving a down payment of USD 1 million by check.
