Three TNI soldiers who murdered a state-owned bank branch head, Muhammad Ilham Pradipta, were given different sentences by the judges of the Jakarta Military Court II-08. Sergeant Major Mochamad Nasir was sentenced to 13 years in prison, Corporal Feri Hariyanto to 7 years, and Sergeant Major Frengki Yaru to 1 year.
"Declare Sergeant Major Mochamad Nasir legally and convincingly guilty of committing premeditated murder together," the judge said while reading the verdict in a hearing on Wednesday (6/3/2026).
In addition to prison sentences, all three were also discharged from their units and required to pay restitution to the victim's family. Restitution is compensation paid by the perpetrator of a crime to the victim or the victim's heirs for losses arising from the crime.
In its ruling, the judge ordered Sergeant Major Mochamad Nasir (MN) to pay restitution to the victim's family amounting to IDR 750 million. If the restitution is not paid, the defendant's assets may be confiscated and auctioned. If the proceeds are still insufficient, Sergeant Major Muhammad Nasri must serve an additional seven months in prison.
Corporal Feri Hariyanto was also required to pay restitution to the victim's family amounting to IDR 500 million. If the restitution is not paid, the defendant's assets may be confiscated and auctioned. If the asset value is insufficient, FH must serve an additional five months in prison. Meanwhile, Sergeant Major Frengki Yaru was not required to pay restitution.
Charges Against the Defendants
Previously, the panel of judges found that the actions of Sergeant Major Mochamad Nasir fulfilled the elements of Article 338 of the Criminal Code (KUHP) in conjunction with Article 55 paragraph (1) 1st of the KUHP in conjunction with Article 458 paragraph (1) of Law No. 1 of 2023 in conjunction with Article 20 letter c of Law No. 1 of 2023. Meanwhile, Corporal Feri Hariyanto (FH) and Sergeant Major Frengki Yaru (FY) were found to fulfill the elements of Article 333 paragraph (3) of the KUHP in conjunction with Article 55 paragraph (1) 1st of the KUHP in conjunction with Article 451 of Law No. 1 of 2023 in conjunction with Article 20 letter a of Law No. 1 of 2023.
After hearing the panel of judges' verdict, the three defendants stated they would consider an appeal. The Military Prosecutor took a similar stance.
